These Terms and Conditions ("Terms") govern your use of the PropertyScribe website and services ("Service") operated by PropertyScribe Ltd ("we", "our", "us"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Description of Service

PropertyScribe provides an AI-powered property description writing service designed specifically for UK estate agents and property professionals. Our Service uses artificial intelligence technology to generate professional property descriptions based on information and images you provide. The Service includes access to our web-based platform, AI description generation, image analysis capabilities, and customer support.

3. User Accounts and Registration

To access our Service, you must create an account by providing accurate, current, and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorised use of your account
• Ensuring your registration information remains accurate and up-to-date

4. Subscription Plans and Payment

Our Service operates on a subscription basis with the following plans:

• Starter Plan: £15 per month for up to 15 property descriptions
• Professional Plan: £29 per month for up to 50 property descriptions

We offer 3 free property descriptions for new users to try our service. Subscriptions automatically renew unless cancelled before the renewal date. All payments are processed securely through Stripe. Fees are non-refundable except as required by law or as expressly stated in these Terms.

5. Acceptable Use Policy

You agree to use our Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for any illegal or unauthorised purpose
• Violate any applicable laws or regulations
• Transmit any harmful, threatening, abusive, or defamatory content
• Attempt to gain unauthorised access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers connected to the Service
• Use the Service to generate false, misleading, or deceptive property information
• Reverse engineer, decompile, or attempt to extract the source code of our Service

6. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of PropertyScribe Ltd and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used without our prior written consent.

You retain ownership of any property information, images, or other content you provide to the Service. By using our Service, you grant us a limited, non-exclusive license to use your content solely for the purpose of providing the Service to you. Generated property descriptions become your property upon creation.

7. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Service, you consent to the collection and use of your information in accordance with our Privacy Policy.

8. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LISTIBLE LTD BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

You agree to defend, indemnify, and hold harmless PropertyScribe Ltd and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

10. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms. You may cancel your subscription at any time through your account settings or by contacting us. Upon termination, your right to use the Service will cease immediately.

11. Governing Law and Jurisdiction

These Terms shall be interpreted and governed by the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
